ICJ RULES STRIKE ACTION IS PROTECTED UNDER KEY ILO LABOUR CONVENTION

The International Court of Justice (ICJ) has ruled that the right to strike is protected under a key International Labour Organization (ILO) convention.

In its advisory opinion, the UN’s top court said strike action falls within the scope of the Freedom of Association and Protection of the Right to Organise Convention, 1948 (No. 87). The court noted, however, that the treaty does not explicitly mention strikes.

The ICJ also clarified that its opinion does not determine the exact scope or conditions for exercising the right. It explained that while the right to strike is protected, its detailed application remains subject to further interpretation.

Although advisory and not binding, the ruling is expected to influence ongoing international labour discussions.
